{"id":81386,"date":"2025-03-13T10:35:33","date_gmt":"2025-03-13T15:35:33","guid":{"rendered":"https:\/\/www.mcguirewoods.com\/?post_type=insight&#038;p=81386"},"modified":"2025-03-13T13:15:54","modified_gmt":"2025-03-13T18:15:54","slug":"epa-announces-31-sweeping-regulatory-reforms","status":"publish","type":"insight","link":"https:\/\/www.mcguirewoods.com\/client-resources\/alerts\/2025\/3\/epa-announces-31-sweeping-regulatory-reforms\/","title":{"rendered":"EPA Announces 31 Sweeping Regulatory Reforms"},"content":{"rendered":"\n<p>U.S. Environmental Protection Agency Administrator Lee Zeldin <a href=\"https:\/\/www.epa.gov\/newsreleases\/epa-launches-biggest-deregulatory-action-us-history\" target=\"_blank\" rel=\"noreferrer noopener\">announced on March 12<\/a>, 2025, that the agency will take 31 deregulatory actions aimed at advancing President Donald Trump\u2019s executive orders and economic agenda. These actions are intended to reduce regulatory burdens, promote domestic energy production and shift decision-making authority back to state governments.<\/p>\n\n\n\n<p>According to EPA, these measures will reduce regulatory costs by trillions of dollars and lower the cost of living on American households, making it more affordable to purchase vehicles, heat homes and operate businesses.<\/p>\n\n\n\n<p>EPA\u2019s deregulatory effort, which Zeldin described as the \u201cbiggest deregulatory action in U.S. history,\u201d is designed to accomplish three goals Trump set: (1) unleashing American energy; (2) lowering the cost of living for American families; and (3) advancing cooperative federalism. EPA will take 31 actions, including reassessing numerous regulations promulgated during the Obama and Biden administrations that Zeldin claims significantly impacted multiple sectors of the economy.<\/p>\n\n\n\n<p>As part of the \u201cUnleashing American Energy\u201d initiative, EPA will reconsider the following regulations:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Greenhouse gas emission limits on power plants (which EPA refers to as Clean Power Plan 2.0)&nbsp;<\/li>\n\n\n\n<li>Emission limits for methane and volatile organic compounds for sources in the oil and gas industry (known as Subparts OOOOb and OOOOc)&nbsp;<\/li>\n\n\n\n<li>Mercury and Air Toxics Standards for coal-fired power plants (MATS)&nbsp;<\/li>\n\n\n\n<li>The mandatory Greenhouse Gas Reporting Program (GHGRP)<\/li>\n\n\n\n<li>Effluent limitations, guidelines and standards for the Steam Electric Power Generating Industry (the ELG rules)<\/li>\n\n\n\n<li>Wastewater treatment standards for coal-fired power plants&nbsp;<\/li>\n\n\n\n<li>The Risk Management Program (RMP) rule for oil and natural gas refineries and chemical facilities<\/li>\n<\/ul>\n\n\n\n<p>As part of the &#8220;Lowering the Cost of Living for American Families&#8221; initiative, EPA will reconsider the following regulations:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Greenhouse gas emission standards for light-, medium- and heavy-duty vehicles (which EPA refers to as the Car GHG Rules)&nbsp;<\/li>\n\n\n\n<li>EPA\u2019s 2009 finding that greenhouse gas emissions endanger public health and harm the environment, as well as the regulations and actions that rely on that finding (commonly called the Endangerment Finding)<\/li>\n\n\n\n<li>The Technology Transition Rule that restricts the use of certain substances in consumer products and in semiconductor manufacturing<\/li>\n\n\n\n<li>National ambient air quality standards for fine particulate matter (PM<sub>2.5<\/sub> NAAQS)&nbsp;<\/li>\n\n\n\n<li>Multiple National Emission Standards for Hazardous Air Pollutants (NESHAPs) \u2014 this action encompasses recent risk and technology review (RTR) and \u201cgap-filling\u201d rulemakings, including NESHAPs for the following industries and equipment\n<ul class=\"wp-block-list\">\n<li>integrated iron and steel manufacturing<\/li>\n\n\n\n<li>rubber tire manufacturing<\/li>\n\n\n\n<li>synthetic organic chemical manufacturing (the HON Rule)<\/li>\n\n\n\n<li>commercial sterilizers (including ethylene oxide) for medical devices and spices<\/li>\n\n\n\n<li>lime manufacturing<\/li>\n\n\n\n<li>coke ovens<\/li>\n\n\n\n<li>copper smelting<\/li>\n\n\n\n<li>taconite ore processing<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p>As part of the \u201dLowering the Cost of Living\u201d initiative, EPA will take the following actions:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Restructuring the Clean Air Act\u2019s Regional Haze Program&nbsp;<\/li>\n\n\n\n<li>Re-examining and changing the \u201cSocial Cost of Carbon\u201d metric used by agencies to evaluate the costs and benefits of regulations affecting greenhouse gases&nbsp;<\/li>\n\n\n\n<li>Exercising EPA\u2019s enforcement discretion to return the focus of environmental enforcement back to EPA\u2019s \u201ccore mission\u201d<\/li>\n\n\n\n<li>Terminating EPA\u2019s Environmental Justice and Diversity, Equity and Inclusion (DEI) initiatives<\/li>\n<\/ul>\n\n\n\n<p>Finally, Zeldin announced that EPA would undertake the following actions to support Congress\u2019 determination in numerous environmental statutes that in many cases the states \u2014 and not EPA \u2014 should be the primary environmental regulator, which EPA calls its &#8220;Advancing Cooperative Federalism&#8221; initiative:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Withdrawing the \u201cGood Neighbor Plan,\u201d which rejected the interstate ozone State Implementation Plans of 23 states and which the Supreme Court stayed pending review by the courts<\/li>\n\n\n\n<li>Working with states and tribes to resolve what EPA says is a \u201cmassive backlog\u201d of State Implementation Plans (SIPs) and Tribal Implementation Plans (TIPs) that states and tribes put together to regulate air emissions within their borders<\/li>\n\n\n\n<li>Reconsideration of EPA\u2019s Exceptional Events Rule to work with states to prioritize the allowance of prescribed fires within SIPs and TIPs&nbsp;<\/li>\n\n\n\n<li>Reconstituting EPA\u2019s Science Advisory Board (SAB) and the Clean Air Scientific Advisory Committee (CASAC)&nbsp;<\/li>\n\n\n\n<li>Expediting state permit reviews under the coal ash program and updating EPA\u2019s coal ash regulations, often called the CCR Rules&nbsp;<\/li>\n\n\n\n<li>Utilizing EPA\u2019s enforcement discretion to assist North Carolina in its recovery from Hurricane Helene&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>EPA\u2019s announcement in and of itself will not make these regulations disappear. The environmental rules and regulations targeted in the announcement remain the law of the land unless and until they are repealed or revised, and they remain in effect unless stayed by a court. Repeal or revision of final EPA rules, and certainly deregulatory action of this sweeping scope, will need to comply with the underlying environmental statutes but also with administrative law procedural and substantive requirements. States and NGOs likely will challenge this deregulatory effort in court, and it will be imperative for EPA to make sure it follows the applicable legal requirements and that the rulemaking records for these actions support the decisions EPA makes for these actions to survive judicial review. For that to occur, the regulated community will need to participate in the rulemaking process, provide evidence to support EPA\u2019s deregulatory actions and bolster the record for the litigation to come.<\/p>\n\n\n\n<p>This is the first of several alerts by McGuireWoods about the programs affected in this latest EPA deregulatory effort.
